Public offer agreement

General Terms

1.1. This document constitutes a public offer by NVECTECH PL Sp z.o.o (hereinafter referred to as the "Seller") to enter into a remote sales agreement via an online store. This offer (hereinafter referred to as the "Agreement") is published on the Seller’s official website: https://nvecexpert.com.

1.2. The Buyer’s payment for an order placed through the online store confirms full and unconditional acceptance of this Agreement, including the prices and terms stated on the website.

Terminology

2.1. For the purpose of this Agreement, the terms listed below have the following definitions:

  • "Product" – any physical goods, including devices, components, and accessories, offered by the Seller.
  • "Online Store" – a digital platform that allows users to browse and purchase goods through electronic contracts in accordance with Polish e-commerce law.
  • "Seller" – the company offering goods via the online platform.
  • "Buyer" – any individual who agrees to the terms and conditions and places an order through the online store.
  • "Order" – the Buyer’s request for selected goods, placed and confirmed via the online platform.

Contract Scope

3.1. The Seller agrees to supply the goods as ordered, and the Buyer agrees to pay for and accept them as per the terms stated herein.

    This Agreement outlines the following procedures:
  • Choosing products voluntarily via the website;
  • Placing an order independently via the online store interface;
  • Making payment for the selected items;
  • Processing and shipping the order in line with this Agreement.

How to Place an Order

4.1. Buyers may place orders for any product available on the website.

4.2. Each item may be ordered in any available quantity unless otherwise stated.

4.3. If an item is temporarily unavailable, the company will notify the Buyer via email or phone.

4.4. If unavailable, the Buyer may request a replacement, cancel the item, or withdraw the entire order.

Payment Terms

Cash on Delivery

5.1. Payment is made in Polish zlotys upon receipt of the order from the logistics provider.

5.2. If payment is not received, the Seller reserves the right to cancel the order.

Shipping Conditions

6.1. Orders are delivered to the nearest pickup location of the logistics company.

6.2. The buyer will receive supporting documentation in accordance with applicable Polish law.

Responsibilities and Rights

  • The Seller may suspend services without notice if the Buyer violates this Agreement.

7.2. The Buyer agrees to:

  • Pay in full and collect the order in a timely manner.

7.3. The Buyer has the right to:

  • Place orders through the online store;
  • Enter into an electronic contract;
  • Request that the Seller fulfill the contract terms.

Liability

8.1. Both parties shall be liable for breach of the agreement in accordance with this Agreement and the applicable law of Poland.

8.2. The Seller is not liable for:

  • Product design modifications by the manufacturer;
  • Minor color discrepancies due to individual monitor settings;
  • Incorrect or incomplete information provided by the Buyer;
  • Service interruptions caused by external factors beyond the Seller’s control;
  • Illegal actions carried out by the Buyer via their internet access;
  • Unauthorized access resulting from the Buyer sharing login details.

8.3. The Buyer is solely responsible for any damage caused while using the online store, including harm to other users, legal entities, or public interest.

8.4. Neither party is liable in case of force majeure – events beyond reasonable control that prevent the fulfillment of contractual obligations.

8.5. The parties agree to resolve disputes amicably through negotiation whenever possible.

Additional Terms

9.1. The Seller reserves the right to unilaterally modify this Agreement. Any changes will be published on https://nvecexpert.com.

9.2. The online store is designed to facilitate remote sales of goods via the internet.

9.3. The buyer is responsible for the accuracy of the data provided when placing the order and consents to the processing of personal data in accordance with the Polish Personal Data Protection Act.

9.4. Payment for the order constitutes full acceptance of this public offer.

9.5. The date of contract conclusion is the moment of acceptance under Article 11 of Ukraine’s Law on Electronic Commerce.

9.6. Browsing the site and placing an order is free of charge for Buyers.

9.7. Buyer information is treated as confidential and used only for order fulfillment, communication, delivery, and billing purposes.

Returns – Non-defective Items

10.2. Return shipping costs are the responsibility of the Buyer.

10.3. Refunds for returned items are issued after deducting delivery costs incurred by the Seller.

Agreement Validity

11.1. The electronic agreement becomes valid upon receipt of the Buyer's acceptance in accordance with the provisions of applicable Polish law on electronic commerce.

11.2. The Agreement may be terminated by mutual consent before goods are dispatched, with refund arrangements.

11.3. Either party may terminate the Agreement if the other fails to fulfill its obligations or under applicable law.

Note: The online store "nvecexpert.com" has the right, in accordance with Polish law, to make its platform available to sole proprietors or legal entities for the purpose of selling goods.
